Course Description:

This course is designed to allow the LSRP to understand the relative roles of the various entities involved in linear construction projects (LCP). ln many LCPs, construction routes often cross contaminated sites, some having been remediated with contamination left onsite. This results in the probability of more than one LSRP being involved. The various entities involved include: the property owner; the entity responsible for the construction; the contractor performing the excavation and their subcontractors; a LSRP "hired" by the responsible entity; and, if applicable, a LSRP for a contaminated site.

This course will examine applicable legal requirements of each of the parties. In particular, the role of the LSRP will be detailed. LSRP liabilities in LCP will be examined and discussed. A case study shall be presented.

Relevance to the Performance of the LSRP:

A linear construction project impacting a remediated or unremediated contaminated site, will require an LSRP to be hired by those responsible for the project. lf a site has an LSRP and has been remediated with an engineering control, close communication between the two LSRPs is essential in order to implement the project so as to be a mutually acceptable. Many unforeseen occurrences are likely to be encountered during implementation. Project and contingency planning will likely require the involvement of both parties so as to result in a successful project which is protective of human health, safety and the environment.

Jorge H. Berkowitz, PH.D., LSRP - Dr. Jorge H. Berkowitz received his Bachelors, Masters and Doctorate degrees, all in Environmental Sciences, from Rutgers University in New Brunswick. Upon completing his Masters degree course work, Dr. Berkowitz joined the faculty of Environmental Sciences at Rutgers in 1970, where he remained until 1980. He joined the New Jersey Department of Environmental Protection in 1980 and remained there until 1989. During this period, Dr. Berkowitz served as the Administrator of the DEP’s Superfund Program, Director of the Air Quality Program, Director of the Department’s Water Resource Management and Protection Program, and briefly as Acting Assistant Commissioner for Environmental Control and Management.

Dr. Berkowitz became an environmental consultant in 1989. He is currently a private consultant offering site remediation expert services in support of client’s responsibilities during remediation or during litigation. Dr. Berkpwitz was previously employed by Langan Engineering and Environmental Services, Inc., and was in charge of the environmental component of their Lawrenceville office. He serves in several capacities as an advisor to the NJDEP and is a member of various Boards of Directors and advisory committees for several professional organizations in New Jersey. Dr. Berkowitz was instrumental in helping formulate necessary changes to the original Site Remediation Reform Act in order to make the law achieve its desired purpose. Dr. Berkowitz was appointed to the Site Remediation Professional Licensing Board in 2010 by Governor Jon Corzine, and reappointed in 2015 by Governor Chris Christie. He is the Board’s chair of the Professional Conduct Committee in addition to a member of the Rules and Operation Committees.

Ted Budzynski, Owner, President/CEO, Enterprise Network Resolutions (ENR) Contracting, LLCHaving 34 years in the industry, Mr. Budzynski’s strong management and engineering background is an integral part of ENR Contracting’s services and success. Mr. Budzynski obtained his B.S. in Chemical Engineering from Widener University while also working for a prominent South Jersey well drilling and wastewater company. Mr. Budzynski then began a long and diverse career, first as a project manager for a hazardous waste remediation company, and within nine years becoming Executive Vice President with the full turn-key company, responsible for all operational and administrative responsibilities at it’s facilities in the Northeast. Forming a start-up remedial service company in 1992, he was responsible for overall company management including Proposal Development, Estimating, Project Administration, Contract negotiations, Field Operations, and overall financial responsibilities. He continues those same duties today as founder of ENR Contracting, a demolition/remedial service construction company focusing on Fortune 500 firms and municipalities requiring environmental solutions to Brownfield and industrial sites.

Continuing Professional Education Services, LLC (CPES), the product of PB&J Continuing Professional Education Services, LLC and has the mission of providing continuing education courses to professionals as well as lectures and special events to the professional community. CPES will be offering courses that provide required credits for Licensed Site Remediation Professionals, attorneys, professional engineers and many other professionals certified and/or licensed in the states of Connecticut, New Jersey, New York, and Pennsylvania to name a few.

Continuing Professional Education Services, LLC is the brain child of Dr. Jorge H. Berkowitz and Philip I. Brilliant. From the inception of the Continuing Environmental Education for Professional (CEEP) program at the College of Science and Mathematics (CSAM) at Montclair State University, Dr. Berkowitz and Mr. Brilliant have been in the classroom and in the boardroom assuring the success of the program. In order to better serve the community of professionals, Dr. Berkowitz and Mr. Brilliant stepped forward with a solution that has saved the ability to offer continuing education credit-bearing courses.
