Collaborative Solutions to Patent Risk

In the United States, NPE patent litigation remains a challenge and a cost to tech companies. More than 60% of US patent litigations are said to be brought by NPEs in 2020. Against the backdrop of potential for patent litigations, companies are creating collaborative frameworks to mitigate the risks. Nowadays, it is necessary for companies to understand these solutions as options for their IP strategies. In this seminar, representatives from Open Invention Network, RPX Corporation, and LOT Network will share how their service models work and discuss tech companies’ IP strategies in defending and promoting their innovations.

Keith Bergelt

CEO, Open Invention Network

Keith Bergelt is CEO of Open Invention Network (OIN), the largest patent non-aggression community in history, created to support freedom of action in Linux as a key element of opensource software. Funded by Google, IBM, NEC, Philips, Sony, SUSE and Toyota, OIN has more than 3,400 community members and owns more than 1,100 global patents and applications. As CEO, Mr Bergelt is directly responsible for enabling, influencing and defending the integrity of the Linux ecosystem. Central to the achievement of his goals is the acquisition and transfer of patent rights designed to permit members of the Linux ecosystem to operate free of the threat of assertion and litigation from those whose business models are antithetical to innovation and global economic growth in information technology and computing.

Before joining OIN, Mr Bergelt was president and CEO of two hedge funds – Paradox Capital and IPI – formed to unlock the considerable asset value of patents, trademarks and copyrights in middle-market companies. During Mr Bergelt’s stewardship of these IP-based lending activities, he raised more than $300 million and financed portfolio companies of private equity firms including Texas Pacific Group, Kelso & Co, JH Whitney, Weston Presidio, Goode Partners, Palladium Capital and Castanea Partners, among others.

Yuichiro Kawamura

Vice President, Business Development, RPX Corporation

Yuichi Kawamura is Vice President of Business Development at RPX Corporation, where he primarily focuses on the auto sector. Prior to Joining RPX in 2019, Mr. Kawamura engaged in a broad range of IP businesses during his 39 years at Honda Motor Co., Japan. He held a variety of senior positions within Honda, most recently as Senior Vice President of Honda Patents and Technologies North America. In this role, he managed all IP related businesses including litigations, transactions, and US IP portfolio management and manufacturing licenses between Japanese and North American Honda group companies based in the US, Canada and Mexico. Under these manufacturing licenses, Honda North American operations generated nearly 2 million products including automobiles, motorcycles, power products, turbofan engines, and commercial jets. Early in his career, before joining Honda, Mr. Kawamura held a number of positions including Managing Director and Vice President of Japan Intellectual Property Association (JIPA) and Vice President of Japan Design Protection Association.

Ilja Bedner

Vice President, Licensing, LOT Network

Ilja Bedner joins LOT with over thirteen years of experience in the intellectual property industry. Ilja was previously at Technicolor, Intellectual Ventures, and Hewlett-Packard. At Technicolor, Ilja was a VP of licensing where he built licensing programs and engaged in patent licensing discussions. At Intellectual Ventures, Ilja was the Managing Director of Strategic Investors Relations where he focused entirely on the needs of strategic investors, licensees, and customers. At Hewlett-Packard, Ilja was the CTO and founding member of HP’s IP Licensing department. Additionally, Ilja has worked on a broad range of embedded software, Internet software, and Internet Infrastructure activities as software developer, technical lead, chief architect, researcher, manager, solutions director, and chief technologist.

Ray Strimaitis

Vice President, Corporate Development & Global Strategy, Allied Security Trust

Ray Strimaitis has over twenty-five years of experience as an intellectual property professional. Previously, Ray served as Vice President and Deputy General Counsel for Yahoo where he led a global team of IP professionals and was responsible for setting patent strategy, monetizing the Yahoo patent portfolio, mitigating patent risk, guiding patent advocacy and overseeing all trademark/copyright matters. Ray established and led a program to monetize Yahoo patents that generated $600 million in patent sales and license transactions. He led the formation of Excalibur IP, LLC – a wholly owned Yahoo subsidiary that was created to further optimize patent value to Yahoo shareholders. Before joining Yahoo Ray served in various legal, management and patent roles at IBM. Mr. Strimaitis received his J.D. from Cleveland Marshall College of Law and his Bachelor of Science in Electrical Engineering from Cleveland State University.

Joseph (“Joe”) Yang

IP Transactions Partner, PatentEsque Law Group, LLP

Joe specializes in structuring & negotiating tech/patent transactions, especially cross-industry, IoT & open innovation deals. He is also a Lecturer in Law at Stanford Law School, and chairs various nationwide advanced licensing programs at the Practising Law Institute. Joe was formerly General Counsel of Cryptography Research (now part of Rambus), and before that, co-founded and led the IP transactions practice at Skadden, Arps (Palo Alto). He is profiled by IAM’s “World’s Leading IP Strategists,” Marquis’ Who’s Who in American Law, and SuperLawyers. He holds a J.D. (Stanford) and Ph.D. in engineering (Caltech).

Organizer of Collaborative Solutions to Patent Risk

Bay Area CHIZAI* (IP) is a unique networking platform (*CHIZAI means IP in Japanese). This group holds a seminar and networking event regularly in the Bay Area. Members are IP professionals, who are doing or interested in Japanese IP practices. Professor Toshiko Takenaka and NEDO Silicon Valley office founded this group. It is currently organized by Yoshinari(Yoshi) Oyama, a JPO examiner and current senior director at NEDO Silicon Valley Office.

The following basic rules are in place to help make all participants feel safe and comfortable while participating in these invaluable discussions:

  • No-confidential discussions: Information brought to the presentation or discussion should not include any confidential matters or other materials that may require non-disclosure agreement or any other legal arrangement.

  • Keeping privacy private: All participants and presenters should always feel free and safe to discuss information and their opinions openly and respectfully. The conversations should be shard commonly across all participants, however any discussion topics or comments must not be publicized without a consensus.

We are a group of curious people who are interested in learning anything about technical, legal and business practices of IP that moves us. We hope that all participants will enjoy the band-new conversation platform as a safe place to network and learn from each other for years to come.
