JULY 15, 2:00pm - Runoff Claims Liability: Financial Closure Mechanisms for Captives and RRGs

The claims liability related to the activities of a captive can be closed in a variety of ways. A captive owner does not have to settle claims, continue to deny or pay them year after year. They aren’t faced with the singular options of having to close their captive or consider selling it. Losses and the management of runoff claims can be assumed by extremely qualified carriers through a variety of transfer processes. The most common of these are referred to as Loss Portfolio Transfers (LPT). These processes are intended to provide the current risk bearer the ability to enter into a retrospective reinsurance agreement with a qualified carrier. This company will continue to manage the claim liability to at least the same degree of efficiency as before. They also maintain the same focus of ensuring adherence to original policy parameters. In addition to LPTs there are Assumption and Novation agreements as well as Insurance Business Transfer agreements.

We’ll touch on why commercial carriers are reluctant, which are writing, and what coverages are available. We’ll also share a conversation on cannabis related captives have been formed to date, where, and which domiciles seem more inclined as well as what is concerning to the regulators and why most domiciles won’t allow.

We’ll continue with info and an update on the safe banking act as well as the likelihood of passage and potential ramifications to the captive industry.
