Faced with dramatic technological advancements, companies need efficient tools to protect their trade marks, a vital commercial asset. Brand owners often seek to block the flow of online information by suing Internet service providers and intermediaries for using their trade marks and other Intellectual Property Rights. How to strike a balance between these rights and consumer choice? What are the legal remedies available? Have domestic and European courts found a satisfactory answer?
