Please join us for the Federal Litigation Project launch party, featuring rooftop cocktails and a very special guest speaker, former Federal Judge Nancy Gertner!

What is the Federal Litigation project?

The Federal Litigation project is chaired by Susan Church, former chair of AILA New England. It is a project of the Massachusetts Immigrant Refugee Advocacy Association in conjunction with the American Immigration Association of New England. The goal of the project is to build the capacity of our community to sue the Federal Government, by pairing experienced Immigration Attorneys with less-experienced AILA attorneys who know the law, but often hesitate to take cases to federal court because of its intricate and complicated rules. These mentoring relationships will result in an immediate increase in immigration cases taken to federal court, and a long-term strengthening of the network of immigration attorneys in New England.

Why now?

Today, immigrants feel attacked and under siege by the rhetoric of the current administration as well as the relentless enforcement efforts of ICE (Immigration and Customs Enforcement). Under the previous administration, ICE, ICE prosecutors, and the Immigration Courts maintained and often exercised some discretion to cancel the removal of immigrants, release immigrants from custody, and grant reprieves for sympathetic cases. This is simply not happening in today's climate. We have an urgent need to litigate against ICE. As a result of prior administration's less aggressive tactics, New England has very few immigration attorneys who are experienced in federal court litigation, and the federal courts have been underutilized as a mechanism to fight deportations. Additionally, immigrants can rarely afford the expensive and time-consuming cost of litigation in federal court. The AILA Federal Litigation project hopes to change that.

What do we hope to accomplish?

When ICE and the judicial system are not challenged, rights are violated, unjust deportations happen, and the law stays static. Our objectives are to:

  • increase the number of experienced federal immigration attorneys;

  • reduce or eliminate the costs of such litigation for clients who cannot afford it;

  • change the law in important ways to grant more rights to immigrants, and;

  • most importantly, to consistently challenge the unfair and overzealous detention policies of ICE.

Simply put, if we do not relentlessly sue ICE and challenge them in court, we can never hope that they will "behave" – and we can never hope to secure fairness and justice for the immigrants who need and deserve both.
