Berkeley Center for Law & Technology and Kilburn & Strode are pleased to invite you to the AI patentability summit: Challenges, excluded subject matter and legal strategies before the EPO & the USPTO

The law and strategies for appropriately protecting AI technologies are rapidly evolving. Are we seeing a convergence between EPO and USPTO practices in this area? Have we reached a global peak of excluded subject matter? Patent examiners and in-house counsel come together to find the answers and propose practical approaches to protecting AI technologies using patents.

Panel 1: Understanding the approaches to AI patentability at the EPO and USPTO

In this session, specialist AI patent examiners from the European Patent Office and United States Patent and Trademark Office come together to compare and contrast their respective approaches to AI patentability. You can expect to learn:

  • How each office approaches AI patentability from the perspective of those making the assessment as to patent eligibility
  • How you might be able to improve your chances of getting AI patents granted at both of these key patent offices
  • The similarities, as well the differences, in legal tests, examination approaches and likelihood of success at the EPO and USPTO
