OSHA Regulatory Update & Enforcement Trends: Is Your Company a Target?, Sponsored by Burns White


Overview:

This program will discuss:

  • the increase in citations under the catch-all 'General Duty Clause" across all industries (ergonomics, workplace violence, heat-related illness);
  • the rise of whistleblowers and how to handle;
  • trends with the enforcement of the newly implemented crystalline silica rule in both construction and general industry;
  • what initiatives to expect from OSHA in 2019 and current state of agency leadership; and
  • what effect, if any the current administration has had on the agency's enforcement trends - is the regulatory environment as business-friendly as was anticipated?

Jeffrey A. Jackson

A former Pittsburgh prosecutor, Jeffrey A. Jackson brings to his clients a wide range of trial experience in state and federal courts across the country. Primarily, Mr. Jackson’s practice focuses on defending Class I and short line railroads in the areas of occupational disease, toxic tort litigation, qui tam matters, and whistleblower actions brought under the Federal Rail Safety Act (FRSA).

In addition, Mr. Jackson is experienced in counseling clients on many risk avoidance strategies pertaining to occupational injury claims and litigation, including establishing corporate health and safety practices, instituting effective claim management strategies, and creating regional resources of health and safety consultants.

As national coordinating counsel for several large corporate clients, Mr. Jackson has been responsible for managing mass tort litigation, coordinating a consistent corporate approach to discovery, and developing national litigation strategies.

Prior to entering private practice, Mr. Jackson served for four years as an Assistant District Attorney in Allegheny County, Pennsylvania, regularly trying criminal jury and non-jury cases on behalf of the Commonwealth. In 1998, Mr. Jackson co-founded Kelly Hayden LLC, a civil litigation firm based in Pittsburgh, where he represented rail industry corporate clients.

After receiving his law degree, Mr. Jackson served as a law clerk to the Hon. Thomas A. Swope Jr. of the Cambria County, Pennsylvania, Court of Common Pleas.

A frequent presenter, Mr. Jackson has lectured at numerous rail industry conferences on a variety of litigation topics, including the defense of whole body vibration lawsuits, the conduct of expert depositions, preparing corporate officers for deposition, aggressive use of discovery in the defense of cumulative trauma claims, and risk avoidance strategies for whistleblower actions brought under FRSA.

Jessica M. Jurasko

Jessica M. Jurasko is an attorney in the firm’s Healthcare and Long-Term Care Group, focusing in the areas of medical malpractice, healthcare, employment, and general liability litigation. She defends nursing homes, home healthcare organizations, hospitals, individual medical professionals, and other executives in professional, general, and premises liability claims.

A seasoned litigator with a diverse practice, Ms. Jurasko has more than 10 years of experience handling all phases of litigation and case management in construction litigation, occupational safety and health, labor and employment, complex insurance coverage, and corporate contractual disputes in state and federal courts, as well as in administrative proceedings in the regulatory context. In addition to her litigation experience and providing counsel to her clients, Ms. Jurasko frequently presents on employment issues, strategies relating to risk management, and regulatory compliance. She has also authored numerous articles and written materials discussing such topics and has provided training for her clients in these areas.

Ms. Jurasko earned both of her degrees, a Juris Doctor and a B.A. in Political Science and History, from Duquesne University. While in law school, she served as President of the Student Bar Association and studied abroad in Rome, Italy. She has been an active member of her law school’s alumni association as an elected member of the Board of Governors, and most recently served as the President of the Duquesne Law Alumni Association in 2015-2016. In 2017, Ms. Jurasko was named Woman of the Year by the Duquesne University School of Law Women’s Law Association in recognition of her leadership, integrity, service, and commitment to actively seeking change and expanding opportunities for women in the legal profession.

Ms. Jurasko is admitted to practice law in Pennsylvania, as well as the U.S. Supreme Court, U.S. Courts of Appeals for the Seventh and D.C. Circuits, and the U.S. District Court for the Western District of Pennsylvania.

Club Casual Attire: collared shirts, turtleneck sweaters, or knit or golf type shirts with collars, tucked into tailored trousers or khakis. Ladies may wear blouses or sweaters with tailored skirts or slacks.
