Overview

Every day, employers - with assistance and direction from In-House Legal Departments are faced with the daunting tasks of anticipating and dealing with workplace challenges, including natural disasters and workplace violence. What can in-house attorneys do to assist HR, managers, and employees in balancing compliance with the law, employee safety, and company operations?

This 3-hour session will cover topics including:

  • Health and Safety issues (OSHA compliance);
  • Compensation Issues (FLSA/pay issues due to business closure, or due to need to work from offsite); and
  • Leave Issues (ADA/FMLA implications of physical or trauma-related injury due to disaster or violence).

In addition, one-hour of the 3-hour session will focus on the ethical implications of balancing business exigencies with the physical and mental recovery of employees affected by workplace disaster/violence. This element of the sessions will assist in-house attorneys by providing an overview of model rules and related ethcial compliance issues, and wil ldiscuss how enhancing effective communication and disaster response create an atmosphere that supports both legal compliance and employee resilience.

The take-aways of this presentation will include an overview of techniques for recognizing the potential for natural disassters and for workplace violence, and assistance in developing compliance policies for both. (All attendees also will leave with an elementary knowledge of general survivial skills, basic sel-defense moves, and active shooter training.)



Presenters: Maria Greco Danaher, Ogletree, Deakins, Nash, Smoak & Stewart and Janet Duderstadt, Alcoa

Maria Greco Danaher regularly represents and counsels companies in employment related matters. She specializes in representing management in labor relations and employment litigation, and in training, counseling, and advising human resource departments and corporate management on these topics. Maria has first chaired trials in both federal and state courts since 1986, and regularly instructs attorneys and students in issues related to trial tactics.

In addition to her litigation experience, Maria regularly acts as a “neutral” for the local federal court’s Alternative Dispute Resolution Program, and was a co-drafter of the local rule related to ADR. She counsels and trains companies on dispute resolution procedures and facilitative communication, and is a member of the firm’s Diversity Steering Committee. Maria also writes regularly for HR News, a monthly publication of the Society for Human Resource Management, and is on the Advisory Board of “You & the Law,” a publication of the National Institute of Business Management. She is a regular contributor to the Allegheny County Bar Association's Lawyer's Journal. She is a presenter for Pennsylvania Bar Institute continuing legal education programs, and is an adjunct professor for the University of Pittsburgh School of Law, and has been named one of the “Best Lawyers in America.”

This program is preapproved for two hours of PA substantive cle credit and one hour of PA professional ethics cle credit.

Hardship Policy: Any lawyer may send a written request for a reduced fee, 30 days prior to program, and explain that the normal fee causes financial hardship, provide background material and must be signed by the lawyer.
