Ethical Quandaries in Discovery, Sponsored by Reed Smith

Ethical Quandaries in Discovery – Litigation discovery touches on numerous ethical issues. This fully interactive game will test your knowledge of ethical rules and opinions that intersect with e-discovery. Model Rules of Professional Conduct 1.1, 1.4, 1.6, 3.4, 5.1, 5.3, and 5.5, the Federal Rules of Civil Procedure, and some recent ethics opinions serve as touchstones for a number of ethical quandaries you will be asked to resolve in the context of a hypothetical case. For ever correct answer, you will climb closer to “ethical paradise,” but beware-many of those ethics rules can trip you up and slide you down toward the dreaded “ethical inferno!”


Presenters: David Cohen and John McIntyre, Reed Smith

David R. Cohen is the chair of Reed Smith’s Records & E-Discovery Group. He has 30 years of commercial litigation experience in a variety of subject matters. David serves as special e-discovery counsel in many cases, represents companies in complex litigation matters, and also counsels clients on records management and litigation readiness issues.

David has been involved in setting up the E-Discovery Special Masters (EDSM) program in the U.S. District Court for the Western District of Pennsylvania, and he has been appointed to serve as an EDSM in three separate cases by three different Federal judges. He also served on the Pennsylvania E-Discovery Rules Subcommittee, chaired by Allegheny County, PA Common Pleas Judge Stanton Wettick.

In addition, David has designed and presented e-discovery training programs for judges and neutrals around the country; has authored numerous legal publications; and is a frequent presenter at continuing legal education seminars regarding e-discovery, technology, and litigation tactics (listing of recent publications and speaking engagements contained herein).

John M. McIntyre's practice focuses on complex business and class action litigation. He has defended more than 25 putative class action matters, many of which were premised on alleged privacy violations. He is currently lead counsel in the largest case of its type in U.S. history, involving $175 million in claims and counterclaims and billions of pages of documents against the Department of Justice. John also has considerable appellate experience, having successfully represented clients in the United States Court of Appeals for the Third, Fourth, and Ninth Circuits. In addition, John is the Global Director of Reed Smith’s Staff Attorney Group.

As a reflection of his strong standing in the legal community, John received an AV Preeminent rating of 5.0/5.0 as a result of a peer review conducted by Martindale-Hubbell. John has also been selected by the United States District Court for the Western District of Pennsylvania to serve as a Special Master for Electronic Discovery based upon his extensive experience in the field.
