Advanced Planning for Rapid Response: Staying Prepared for Data Security Breach Litigation, Sponsored by Reed Smith

Companies gather, use, store, and share personal information every day. Even the most carefully run company can experience a breach in the security of that information, be it from a hacker, a disgruntled employee, or a stolen or lost laptop. Any such data incident requires an analysis of 48 state breach notification laws, as well as more specialized federal statutes and contractual obligations, a formerly time sensitive process that Reed Smith has made more efficient with an app, Breach RespondeRS. Hundreds of companies across the country have also faced major class action lawsuits in response to even minor breaches. This course will provide an overview of federal and state data security laws, demonstrate the breach notification app, use case studies of actual data security class action suits filed, and survey ideas that have proved successful in the defense of such cases. In addition, best practices for responding to government inquiries, and for prosecuting or defending against business-to-business or insurance coverage litigation that might arise from a breach, will be discussed.


Presenters: John M. McIntyre and Mark Melodia, Reed Smith


John M. McIntyre's practice focuses on complex business and class action litigation. He has defended more than 25 putative class action matters, many of which were premised on alleged privacy violations. He is currently lead counsel in the largest case of its type in U.S. history, involving $175 million in claims and counterclaims and billions of pages of documents against the Department of Justice. John also has considerable appellate experience, having successfully represented clients in the United States Court of Appeals for the Third, Fourth, and Ninth Circuits. In addition, John is the Global Director of Reed Smith’s Staff Attorney Group.

As a reflection of his strong standing in the legal community, John received an AV Preeminent rating of 5.0/5.0 as a result of a peer review conducted by Martindale-Hubbell. John has also been selected by the United States District Court for the Western District of Pennsylvania to serve as a Special Master for Electronic Discovery based upon his extensive experience in the field.


Mark S. Melodia is the founder of the firm’s Information Technology, Privacy & Data Security Group and co-chair of the IP, Tech & Data Group. He has recognized experience in litigating putative class actions and other "bet-the-company" suits in the following three areas: (1) data security/privacy; (2) mortgage/financial services; and (3) other complex business litigation.


Mark has defended more than 80 putative class actions arising from alleged consumer privacy violations, both in the data breach and website/mobile app space. He routinely represents clients responding to government privacy investigations before the FTC, Office for Civil Rights, state attorneys general and the DOJ.
