1B - Yes, They Are Worth (More Than) The Paper They Are Written On: Enforcing Non-Compete Agreements and Protecting Trade Secrets and Other Intellectual Property

The new federal Defend Trade Secrets Act is a welcome addition to the arsenal of companies looking to protect their valuable trade secrets and intellectual property. This session will look at the new DTSA, and discuss the following:
- What does it take to prepare enforceable non-disclosure, non-compete, and non-solicitation agreements?
- How can companies best position themselves to enforce these agreements?
- What guidance has the courts provided in trade secret and non-compete litigation?
1C - Key Policies and Trends for Employee Handbooks and Policies
Presented by: David Freedman
Savvy employers understand that an employee handbook is the first line of defense when employees sue. Given this importance and the myriad employment law changes over the past few years, it’s probably time to give your handbook a tune up. During this session, we will discuss ways to improve your employee handbook and a number of “can’t miss” topics to address, like social media usage, use of company IT resources, labor law traps, and updating your FMLA/ADA policies. Learn how well-drafted employee handbooks help employers manage litigation risks and how the lack of certain policies can increase your organization’s exposure.

2A - Immigration Under the New Administration

Learn the latest on how the new administration’s policies on immigration and workplace compliance impact your business practices. In this session we will cover the new “smart” Form I-9 and its substantive changes, unfair immigration-related practices concerning document abuse and penalties for violation, and the ever fluid concern over the president’s executive orders.
2B - Effective Employee Wellness Programs and Navigating the Compliance Labyrinth
Presented by: David Ledermann and Mark Smith
The prevalence of employee wellness programs highlights the need for scrutiny of their effectiveness and careful consideration of the program features best suited to an organization’s workforce. A wellness consultant will join Barley Snyder benefits lawyers in a session focused on the often confusing array of wellness program options facing employers. These include, among others, physical fitness and healthy lifestyle education and promotion, mental health programming, biometric screening, health risk assessments, disease prevention and management, and incentives for participation or attaining health-related goals. Attorney presenters will address the often varied legal compliance considerations attending different wellness program features under an alphabet soup of laws, including the ADA, ADEA, HIPAA, GINA and ERISA.
2C – Workers’ Compensation: The Panel Physician
Presented by: James Rochester, M.D., FAAFP and Joshua L. Schwartz
The Workers’ Compensation Act permits employers to direct care for the first 90 days following an injury through a designated “panel” of providers. These providers often play an important role in defining the scope of injury, making referrals to specialists, and setting expectations regarding work ability. But employers often don’t take enough time to consider who is appropriate for their panel and how to interact with these physicians during the period of directed care. In this session, we will discuss the legal framework of the panel list and offer strategies you can use to help the providers help you get injured employees back to work.

3B – Navigating Pennsylvania’s Medical Marijuana Act and the Creation of a New Protected Class
Presented by: Joshua Schwartz, Kim Smith and David Walker
In April 2016, Gov. Tom Wolf signed into law Pennsylvania’s Medical Marijuana program. The program is expected to be fully implemented by 2018, and offered to medical marijuana patients who are residents of the Commonwealth and under a physician’s care for the treatment of a serious medical condition as defined by the Act. This session will provide a broad overview of the anticipated program and the potential impact on employers as it relates to drug-alcohol policies, reasonable accommodations under state and federal law, work-related injuries, fitness for duty and other work-performance related concerns as well as the preliminary regulations governing the implementation of the program.
3C – Checks and Balances - A Look Back and a Look Ahead at Wage and Hour Law Developments From Our Courts, Congress and the Trump Administration

- Background on the new Secretary of Labor and Supreme Court nominee
- Has the death bell been sounded for the Department of Labor’s Overtime Regulations, or can we expect revised regulations under the new administration
- Outlook for minimum wage increases, and minimum wage and paid sick leave requirements for federal contractors

- Development of wage and hour issues in Pennsylvania
