Event description

Description

The USD School of Law & Community Defenders, Inc. presents:

Who Makes the Call? You or Your Client?

For too long, criminal defense lawyers have believed that a client has got to make only four decisions about his or her case, namely (1) whether to plead guilty or not guilty; (2) whether to testify at trial; (3) whether to waive jury trial and (4) whether to forego the appeal. The rest of case-related trial management decisions/strategies were solely the province of the lawyer.

This incorrect premise is based on the fact for most, if not virtually all of us, law school did not prepare us on how to make the kinds of decisions that must be made by both the lawyer and the client.

This seminar focuses on well-established and recent law, both by federal and state courts, on attorney-client decision making. The recent decision of the United States Supreme Court in McCoy v. Louisiana provides a central theme for presenters, all of whom have extensive experience in decision making.
