A wide spectrum of Operational Risk incidents are in the news.  Executive Management in the private sector, law enforcement and the military are investigating cases of identity fraud, cyber hacking and insider digital sabotage, transnational economic crime, intellectual property theft, ACH cyber robbery, counterfeiting, workplace violence and industrial espionage.  Government agencies and regulatory authorities are increasing oversight, compliance and reporting requirements with the private sector and federal contractors.  Inspector Generals and Internal Affairs are addressing whistleblower claims and internal corruption.  Homeland security and "Connecting the Dots" are on almost every Americans mind.

All of these Operational Risk Management (ORM) challenges require comprehensive, efficient and legally compliant intelligence-led investigations to establish the ground truth and then to enable a "DecisionAdvantage."  The legal framework that establishes your organizations ability to provide a "Duty to Care", "Duty to Warn", "Duty to Act" and "Duty to Supervise" is imperative.


Doug DePeppe is the co-founder of Trust Anchor, an Information Security and Brand Integrity Advisory firm.  Recently, Doug served as an attorney in the Office of General Counsel, Department of Homeland Security, advising the National Cyber Security Division (NCSD).  At DHS, his portfolio spanned cybersecurity operations, national cyber policy, privacy, and information sharing frameworks between government and the private sector, while servicing clients such as US-CERT, the National Cyber Security Center and senior cyber leaders.  His experience includes various CNCI-related initiatives concerning information sharing, cybersecurity governance, cyber education, the EINSTEIN intrusion detection system, interagency cyber operations, public-private partnerships, and critical infrastructure protection. He has worked hand-in-hand with US-CERT to develop signature review processes to ensure privacy protection and compliance with federal law and department policies.  Doug has written DHS legislative initiatives related to enhancing cybersecurity and served on the Lawyers Group of the White House 60-day Cyber Review.  Prior to joining DHS, Doug was an associate at Booz-Allen-Hamilton consulting firm.

Doug has specialized in cybersecurity-related law, policy and strategy.  He retired from the Army JAG Corps after serving as Legal Director, Army Network Security and Operations Center where he pursued ground-breaking legal work associated with the Army’s seminal involvement in computer network operations, including support to USSTRATCOM, JTF-GNO, and the Joint Functional Component Command for Network Warfare.  Prior to his involvement in cyberlaw, Doug was primarily a litigator, having prosecuted and defended cases in military trials for seven years, including many highly-visible, complex and dynamic jury trials.  He also advised sensitive investigations involving senior officials in the Army, and computer forensic investigations.

Doug has a Juris Doctor Degree and two LL.M. Degrees, most recently gaining his LL.M. Degree from The George Washington University Law School where he specialized in cyberspace-related disciplines, intellectual property, national security and telecommunications.

At Trust Anchor, Doug advises clients regarding ePolicy and Corporate Governance as well as conducting training.  As an attorney, his information security engagements can often be cloaked under the attorney-client privilege to protect clients from discovery risks. 


When does information that is collected become a violation of a persons privacy or legal rights? At the point it is collected from a source or how and when it is analyzed by a human?  These questions and more will be discussed as the dialogue pursues the latest challenges in Forensic Intelligence, a fast and forensically sound data acquisition, analysis and review solution for front line officers from the corporate investigations, law enforcement and government communities.

These Intelligence-led investigations also leverage the use of new forensically sound methods and proven legal procedures for collection of digital data from a myriad of technology platforms including laptops, PDA's and cell phones and more. These methods have been tested and certified in the forensic sciences for decades and follow many of the legally bound and court tested rules associated with evidence collection, preservation and presentation. Digital Forensic tools and 21st century capabilities enable global enterprises, law enforcement and governments to not only discover what they are looking for and when to use this in a court of law to find the truth.


Peter L. Higgins, a 25+-year veteran in the Information Technology industry and a ISO 27001 Certified Lead Auditor, founded 1SecureAudit in 2001. He started his career with Harris Corporation and has managed teams in small boutique management consulting firms and systems integrators. Most recently, his projects have included Information Risk Strategy Execution, Corporate Enterprise Security Intelligence, Executive Protection Security Detail, Corporate Investigations and the Critical Infrastructure Resiliency domains. In his role at 1SecureAudit, Peter is responsible for the delivery of an Operational Risk Management Framework and to analyze and manage new threats in clients' operations in the face of increasing loss events. Peter has contributed to the growth of two ABS Capital Partners portfolio companies since 1999 as a founding employee of Simplexity, Inc. that was later sold to wireless infrastructure provider InPhonic, Inc. for $20 million in early 2002. As a Director at Cyveillance, Inc., his projects involved Enterprise eBusiness Intelligence solutions for the Fortune 50.


He is a Member of the CISO Executive Forum, a Professional Member of the Risk Management Association (RMA), Association of Certified Fraud Examiners (ACFE) and also ACP, the leading global association for expertise among business continuity management practitioners and contingency professionals. He is a Graduate of the FBI Domestic Security Executive Academy 2009-Quantico, VA, FBI Citizens' Academy 2006 -Washington Field Office and Member of InfraGard, protecting the United States Critical Infrastructures including Membership with the Maryland Anti-Terrorism Advisory Council (ATAC). Peter has a Bachelor of Arts degree in International Affairs and a Master's Certificate in Information Technology Project Management from George Washington University's School of Business and Public Management.
