The lecture will deal with alternative means of resolving cross-border disputes, with a focus on international commercial arbitration and other methods of alternative dispute resolution (ADR). The number and importance of arbitration (and mediation) institutions have grown in the past decades and years, and so has competition between the players in the field. And yet, there has been a rising discomfort with their efficiency, their duration, and their costs. The increasing discomfort has led to various reforms such as emergency arbitration, third-party funding, and technological improvements, as well as a the establishing of new international commercial courts, and the creation of mixtures between arbitration and other ADR mechanisms such as mediation. The lecture will provide in an insight to these new developments with a focus on Europe, not without comparing them to the state of affairs in the United States, Asia, and other parts of the world.
