“An Inflection Point in Land Development? Private & Public Conditions Considered”

WHAT MADE SENSE IN THE PAST CAN HOLD BACK THE FUTURE. WHAT CAN BE DONE TO CHANGE PREVIOUSLY ESTABLISHED PRIVATE AND PUBLIC land development CONDITIONS? HAVE WE REACHED AN INFLECTION POINT IN LAND DEVELOPMENT?

In future development of real property along with acquisitions, financing, construction and leasing, the topic of land development is central to the commercial real estate industry and its attorneys as we try to meet the changing needs of society.

Privately created restrictions on use and affirmative responsibilities – those ‘covenants running with the land” – structure condominiums and homeowner associations, retail shopping centers and other real property where rights and duties of different levels of owners and users stand in the way of the future needs of society.

Likewise in the public sector, previously established land development conditions - exactions, impact fees, in-lieu fees which may have made sense when adopted may no longer support today’s land use goals and policies.

Both these private and public conditions were intended to be forever. This Kratovil Conference brings together scholars, practitioners and industry professionals to consider the issue of how the past is holding back the future.

Presenters will consider the possibilities of making changes needed for the future, will provide proposals on how to repurpose old uses to meet current needs and will make practical suggestions on how to respond to this inflection point.
