Legal Issues of Mobile Development

Are you planning or currently developing a mobile app? Learn about all the legal issues you may encounter, and how to steer your app and your company through them.
This class aims to provide an overview of legal issues that companies may encounter when developing and selling mobile applications, and will cover:
- aspects of corporate, employment, IP and privacy laws;
- why mobile apps developers should incorporate their businesses and why a dual company structure may be preferable;
- employment law aspects and who actually owns the app being created, focusing on the difference between independent contractors, volunteers and employees and the importance of work-for-hire agreements (and what they should actually say);
- the negotiation of master services agreements and statements of work, which are important for those who decide to outsource any aspects of app development;
- how to protect the app using trade secrets, copyrights and trademarks, and how to legally integrate works of others (such as sounds or images) into your app;
- the Digital Millennium Copyright Act of 1998 and the FTC rules regarding testimonials and endorsements and other federal laws applicable to mobile apps, in particular the Children’s Online Privacy Protection Act.
