Preparing to License Your Patent

Many inventors have unrealistic expectations as to what their patents are worth. Many inventors are shocked when they learn of Wanetick’s Law which states that “90% of patents are not in the top 10%.” As a result, inventors are often too aggressive and often price themselves out of the licensing market.

 This discussion will shed some light on how inventors can prepare for negotiations with potential licensees. Among the issues to be discussed are:

·         Documents to get in order

·         Merits of retaining intermediaries

·         Assessing deal congruity

·         Understanding terms used in negotiations

·         Determining deal momentum

·         Best time to license

·         Pricing in risk and development costs

·         Deal structuring options – ascending, descending royalties, royalty caps, minimums, milestones, etc.

·         How to determine the value of your patents using market comparables

·         How to determine the value of your patents using market using the discounted cash flow method

 

BIO

David Wanetick is managing director of IncreMental Advantage LLC, a valuation firm with expertise in valuing intangible assets and emerging technologies based in Princeton, N.J. He is the author of three books and numerous articles on patent valuation. He is the director of the Certified Patent Valuation Analyst program. He is an instructor at The Business Development Academy and has lectured all over the world.
