Legal Aspects of Electronic Communication

Electronically stored information is more than just e-mail and document files. Electronic information also includes images, voice mails, flash memory sticks, cell phones, PDA’s and BlackBerry devices. Businesses increasingly rely on these types of electronic devices to communicate effectively and efficiently. This increased dependence on e-communication, along with a growing body of state and federal statues governing privacy and storage has created additional risks which businesses need to manage. This workshop will focus on the legal aspects of electronic communication including:

  • Storing electronic information
  • Newer technology: instant messaging, blogging, message boards, cell phone cameras, scanners
  • Preserving electronic information and the “duty to preserve” evidence trigger
  • Consequences of failure to preserve
  • Scope of duty to preserve
