The Law on Prior Written Notice and Practical Compliance Strategies

The Individuals with Disabilities Education Act (IDEA) requires prior written notice (PWN) whenever a school district proposes or refuses to initiate or change identification, evaluation, educational placement, or the provision of FAPE to a child with a disability. Experienced school attorney Elena Gallegos will discuss U.S. Department of Education guidance and case law that address the specifics of PWN, particularly in the context of a change in the Individualized Education Program (IEP) of a child with a disability. Ms. Gallegos will explain the difference between PWN and notice of an IEP meeting; and discuss the purpose, timing (including waiver), and level of detail of a legally sound PWN. A question and answer period will also be provided.
