Event Details

The purpose of holding a public hearing is to obtain public testimony or comments on the Environmental Protection Agency’s 404(c) action on the Spruce No. 1 Mine project. The EPA Regional Administrator has determined that there is a significant degree of public interest in the proposed determination for Spruce No. 1 Mine and believes a public hearing would be in the public interest.  As a result, a hearing will be held to obtain comments on whether the proposed determination should become the final determination and on corrective action that could be taken to reduce the adverse impact of the discharge.


Members of the public are encouraged to attend the public hearing (on-site registration begins at 5 p.m.; hearing begins at 7 p.m.) on May 18, 2010, at the:

Charleston, West Virginia 25301


Pre-registration (for speakers and attendees) has closed; however, you may still register on-site at the meeting.  On-site registration begins at 5 p.m.

There are still a limited number of speaking slots open for those who sign up the day of the hearing. You also will be able to place your name on a stand-by list upon arriving at the public hearing.  If someone who has signed up to speak does not attend or does not speak, additional time slots will open up.  

Due to time and room capacity limitations (local ordinances require the Civic Center to close at midnight and limit capacity to 999 occupants), there is a limited number of speakers who can be accommodated during the public hearing, and oral statements will be limited to two minutes per person. The Presiding Officer will establish other reasonable limits on the nature and length of time for oral presentation. There will be no cross examination of any hearing participant. The Presiding Officer may make appropriate inquiries of any such participant. Written comments will be received and will become part of the official record of the Public Hearing. Audio-visual equipment will not be provided.

If you have registered to speak, you should have received an e-mail notification indicating the time slot in which you will be allowed to speak.


Although the room capacity is 999 people, there is area for overflow outside of the room.  Please also note that the hearing will be webcast live at www.wvmetronews.com.


EPA encourages you to provide your comments in writing no later than June 1, 2010.  If you would like to provide comments on the Spruce No. 1 project you may still submit your comments, identified by Docket ID No EPA-R03-OW-2009-0985, no later than June 1, 2010 by one of the following methods:

1. Federal eRulemaking Portal (recommended method of comment submission): http://www.regulations.gov. Follow the online instructions for submitting comments. Or, go directly to the comments page for this action.

Such deliveries are only accepted during the Regional Office’s normal hours of operation, which are Monday through Friday, 8:30 a.m. to 4:30 p.m., excluding federal holidays.

Written comments may also be hand-delivered at the May 18, 2010 public hearing.
5. Place your name on the stand-by list on site at the Public Hearing.  There may be a limited number of additional speaker time slots available if any of the people who registered to speak are not at the meeting.  If a registered speaker is absent at the meeting, the time slot will become available.
