The New “First-Inventor-to-File” Act: What Every Startup Should Know
The new "first-inventor-to-file" provisions of the Leahy-Smith America Invents Act have now gone into effect, and new patent applications are now subject to a radical new philosophy: that the first person to file a patent application on a new invention will be entitled to receive a patent. This is a major conceptual change from the former system of "first to invent" which has persisted in the U.S. patent system for centuries.

Daniel E. Sineway is an associate in the Morris, Manning & Martin Intellectual Property Practice and is a registered patent attorney. He practices in all areas of intellectual property law, including patent prosecution, trademark prosecution, copyright and trade secret. He has extensive experience preparing and prosecuting patent and trademark applications, managing national and international IP portfolios, formulating patent and IP strategies, and rendering opinions. Mr. Sineway often works with emerging and start-up companies to help develop their overall IP strategies and portfolios.
Mr. Sineway’s practice focuses primarily on technology businesses, including those in the fields of computer software and computer-implemented technologies, electronic commerce and payment systems, social media technologies, electronic medical records and healthcare systems, network security, “green” technologies, and many others. He also has extensive experience representing clients in the fields of manufacturing, medical devices, electromechanical technologies, nanotechnologies and power management systems.
